These terms and conditions for the provision and use of the Service (hereinafter referred to as “The Regulations”) are a distance contract, which prescribes The Customer and Service provider APP Latvian Biomedical Research and Study Centre (hereinafter referred to as “BMC”), Regi. No. 90002120158, legal address Rātsupītes Street 1 k-1, Rīga, LV-1067, mutual rights, duties, and responsibilities when registering and using the service. The Customer confirms that they accept these terms and therefore The Customer is obliged to read and familiarise oneself with these terms carefully before registration is made.
Contract signing
Upon entering into a contract, which is acceptance of The Regulations, The Customer shall certify that they have reached the age of 16, are of legal capacity and are not under the influence of any alcoholic, narcotic and/or psychotropic substances, including not entering into the contract within the scope of their economic or professional activities.
The agreement will take place when The Customer accepts these terms and completes registration for the service by creating an account on the polygenictest.biomed.lu.lv platform.
The scope and informative nature of the service description
BMC provides The Customer with the ability to view the results of its polygenic risk calculations based on The Customer's genomic DNA sequencing data obtained by The Customer's transfer of the biological sample for scientific research to BMC, signing the informed consent document, and collecting their genome, health and personal information (hereafter information) in a secure, fast and professional manner on the BMC platform, the established Customer account on SERVERS owned by BMC, BMC's registered website https://polygenictest.biomed.lu.lv/.
A secure sockets layer (SSL) is used to identify BMC servers and ensure data transfer security on the web. The information that The Customer stores in their Customer account belongs to The Customer.
BMC does not offer or provide medical advice, set diagnoses or replace medical practitioners. The information The Customer has entered into the BMC program is for the sole purpose of helping The Customer create a personal archive about their health. The information received through the BMC programme shall be used for information purposes ONLY.
Obligation to register
The Customer undertakes to provide true and accurate registration data.
Customer account and password
4.1. When signing up, The Customer creates a username and password for themselves.
4.2 The Customer shall be responsible for non-disclosure of its password and shall be fully responsible for any action taken using the Customer account and password.
4.3. The Customer has the right to allow other people to access their account information.
4.4. The Customer account may be locked after multiple failed account access attempts. Unlocking The Customer account occurs after re-authentication with Google, Latvija.lv, Smart-ID systems.
4.5. The connection session is terminated if the operation does not take longer.
4.6. Customer agrees to inform BMC immediately of any unauthorised use of your password or any other breach of security.
4.7. BMC shall not be liable for any loss or damage resulting from The Customer's failure to comply with the provisions of this section of the contract.
Customer and BMC liability
5.1. The Customer shall be responsible for the content of the information uploaded to the Customer's account, its veracity and compliance with the requirements of regulatory enactments. BMC does not control the content of information that is deployed through the service and does not guarantee the accuracy, integrity, or quality of the content of that information.
5.2. The Customer undertakes not to use the Service to upload, post, e-mail, or otherwise transmit any information that is unauthorized, indecent, contrary to laws or good morals, or unacceptable for other reasons, and The Customer undertakes to pay to BMC all and any damages resulting from such unlawful actions by The Customer.
5.3. BMC is not responsible for the content, use or consequences of the use of the information and Service, either for The Customer or for third parties.
5.4. The Customer or BMC shall not be liable for non-performance of the BMC Service contract if it occurs as a result of force majeure or extraordinary circumstances which could not have been foreseen, prevented or affected and for which neither The Customer nor BMC is responsible, i.e., natural disasters, war activities, blockades, civil unrest, strikes, etc.
Service security and privacy
6.1. The Customer agrees that BMC processes The Customer's sensitive data in accordance with the laws and regulations of the Republic of Latvia governing the processing of personal data.
6.2. BMC undertakes to protect the privacy of The Customer and to ensure the security of The Customer's information by taking physical, electronic and procedural protective measures, observing the requirements laid down in the laws and regulations of the Republic of Latvia.
6.3. The Customer grants the rights to the BMC to process The Customer information. The information collected in the BMC programme may be stored and processed in Latvia or any other EEA country. The Customer, through the BMC program, agrees to such a transfer of information, observing all security and confidentiality regulations laid down in Latvia and the European Union regarding the processing of sensitive data of natural persons.
6.4. For system security purposes, BMC can collect information - IP addresses, browsers, and site visits - how often the site is visited and pages visited on the website through cookies.
6.5. For statistical purposes, BMC may provide verified and trusted collaborators (third parties) with information on the website visit – number of users, gender percentage distribution, age groups, and pages visited on the website, ensuring that Customer identification and contact are not tolerated.
6.6 BMC shall not be liable for any loss or damage resulting from The Customer's failure to comply with the provisions of this section of the contract.
Use and storage of information content
BMC may impose restrictions on the use of the Service that may be sent or received within the Service from the account concerned, the maximum content of the information, and the maximum space allocated to The Customer on BMC servers.
Termination of service
8.1. A Customer has the right to close their Customer account at any time.
8.2. BMC may suspend The Customer account and/or delete Customer information if BMC considers that The Customer violated or acted in violation of these terms.
BMC ownership
9.1. The Service and the necessary software used in connection therewith, the BMC program, contain confidential information protected by applicable intellectual property laws and regulations.
9.2. BMC grants The Customer temporary personal, non-transferable and non-exclusive rights to use the BMC program during the term of this agreement, provided that The Customer does not reproduce, replicate, copy, modify, create derivative works, reverse process, reverse assemble, or otherwise attempt to discover any source code, use any part of BMC Service, use the Service or access to the Service for commercial purposes, sell or otherwise transfer rights to the BMC program to third parties, and prevent third parties from doing so.
9.3. The Customer undertakes to pay to BMC all and any damages resulting from such unlawful activities of The Customer.
Warranty Disclaimer
10.1. The Customer assumes the risk of using the Service and agrees that the Service is provided to the extent and quality it is at the date of conclusion of this contract.
10.2. BMC does not guarantee that (i) the Service will meet The Customer's requirements; ii) the Service will be continuous, timely, and without errors; iii) the results of the use and use of the Service will be true and reliable.
10.3. Any advice or oral or written information received by The Customer from BMC or through the Service shall not give rise to any warranty not expressly provided for in this Regulation.
Liability limit
The Customer agrees that BMC is not liable for any direct or indirect loss, including any loss of profit caused by (i) use or use of the Service or inability to use or use it; ii) inconsistency or inaccuracy of the content of the information (health and personal data entered); iii) any other issues related to the use or use of the Service; iv) statements or activities of a third party in the Service; v) the use or use of an unauthorised Service by a third party, if the use or use of such uncorrupted Service has not occurred due to the FAULT of the BMC.
Use of the Service and restrictions on use
12.1 To use the Service, The Customer must have direct access to the web and an appropriate Internet browser.
12.2. The Customer has access to help by sending BMC electronic mail.
12.3. When using the Service, it is prohibited for The Customer to i) use the Service in such a way that it would harm BMC and/or any BMC Customer; ii) to use a part of the Service as a recipient of unwanted e-mails to a large number of people or unwanted commercial e-mails (“spam”); iii) use unauthorised software or Service, automated process or Service (such as spider, robotic (BOT) or meta-search engine) to access, use or interfere with the Service; iv) to use any means to modify or reroute (send to the wrong address) the Service or to attempt to modify or reroute it; v) damage, disable, overload or weaken the Service (or network (s) connected to the service) or prevent another user from using the service; vi) resell or resell a Service or any part thereof.
12.4. The Customer undertakes to pay to BMC all and any damages resulting from such unlawful activities of The Customer.
Consent to the electronic receipt of information
The contract shall be concluded in electronic form. If, in accordance with the laws and regulations of this contract, BMC sends information to The Customer, it will be sent electronically.
Advertising
You agree that an ad may be placed on the polygenictest.biomed.lu.lv portal, and you may be sent emails or sms messages that may also contain third-party advertising. You can sign off or opt out of this type of marketing information at any time by using the opt-out link provided in each news email or sms message.
General Provisions
15.1. The Customer must also comply with additional rules that may apply when The Customer uses related Services or third-party software.
15.2. The laws and regulations of the Republic of Latvia shall be applicable in relations between The Customer and BMC.
15.3. BMC and The Customer shall settle disputes by mutual agreement; if it is not possible to agree, the dispute shall be settled in the Court of General Jurisdiction of the Republic of Latvia. BMC has the right to record telephone conversations between The Customer and BMC and The Customer recognises the records of those conversations as evidence between The Customer and BMC in dispute resolution and/or court.
